Trump’s Executive Order Defines Gender as Male or Female at Birth, Rolling Back Transgender Protections

On January 20, 2025, President Donald Trump was inaugurated for his second term, alongside Vice President JD Vance. In his inaugural address, he declared January 20 as “liberation day,” marking the start of a “golden age of America” and a “revolution of common sense.”

Among the executive actions announced, President Trump emphasized that the U.S. federal government will officially recognize only two genders: male and female. This policy shift is set to impact various federal protections for transgender individuals. Specifically, an executive order titled “Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government” is expected to be signed, defining gender strictly based on birth assignment. This order will influence federal policies, including passport gender markers, reverting to pre-Biden administration rules. Additionally, it will instruct the Bureau of Prisons to house transgender women according to their birth sex and limit healthcare for transgender inmates.

Furthermore, President Trump plans to end diversity, equity, and inclusion (DEI) programs within federal agencies. An executive order will prohibit the use of federal funds to promote “gender ideology,” affecting policies related to sex markers on U.S. passports and restricting medical transition treatments for prisoners. The implications for the U.S. military remain unclear, though during his first term, Trump had announced a ban on transgender troops, a decision that was later overturned by President Biden in 2021.

These actions align with President Trump’s campaign promises and mark a significant shift from former President Biden’s policies. While executive orders can be challenged and overturned, this move signals the administration’s stance on transgender rights, possibly leading to legal battles and opposition from LGBTQ+ advocacy groups.
